if you go into an actual AT&#38;T store, and tell them you want to buy an iPhone, I'd be willing to bet that even though your contract isnt elligible for *upgrade*, you can still RESIGN it at ANY TIME.  

Resigning it, as far as I know, would count you as a "new" customer, as you would have to change your plan.

On four different occasions, I have gone in to buy a new phone, and each time, all I had to do was agree to RESIGN my contract to get the phone at subsidy cost.  

Afterall - it extends your contract, AT&#38;T gets even MORE money out of you, so they should be happy.

Wording is the key.  At apple.com/store, you can find this quoted.  "Requires new 2-year AT&#38;T rate plan, sold separately."  

If you're resigning your contract at the new rate, it would be a NEW plan.

Therefore, if you're dogging AT&#38;T for "not giving you the subsidy price", I wholeheartedly disagree.  I'd be willing to bet they would give it to you for the price, as long as you RESIGNED your contract.

I have not seen ANYWHERE that says you have to be elligible for upgrade to get the price.  That would cut a LOT of AT&#38;T's users out of the new phone, which would make them LOSE sales.</description>
